Please read these terms carefully before using Peekaboop.

1. Acceptance of Terms

By creating an account or using Peekaboop, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you may not use the service.

2. Description of Service

Peekaboop is a photo editing service that uses artificial intelligence to add hats and sunglasses to children's faces in your photos. The service helps protect children's privacy when you share photos online.

3. Age Requirement

You must be at least 13 years old to use Peekaboop. By creating an account, you confirm that you meet this age requirement.

4. Account Registration

Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

Accurate Information: You agree to provide accurate and complete information when creating your account.

Account Termination: You may delete your account at any time through the app settings. We may suspend or terminate your account if we believe you have violated these terms.

5. Acceptable Use

You agree to use Peekaboop only for lawful purposes and in accordance with these terms. You must not:

• Upload photos that you do not have the legal right to use or share

• Upload content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable

• Upload content that infringes any copyright, trademark, trade secret, or other intellectual property rights of others

• Use the service to harm, threaten, or harass any person

• Attempt to gain unauthorized access to the service, other users' accounts, or our systems

• Use automated systems (bots, scrapers) to access the service

• Interfere with or disrupt the service or servers

• Violate any applicable laws or regulations

We reserve the right to remove any content and suspend or terminate access to users who violate these rules.

6. Content Ownership and Licenses

Your Content: You retain full ownership of all photos you upload to Peekaboop. We do not claim any ownership rights to your original or edited photos.

License to Peekaboop: By uploading a photo, you grant Peekaboop a limited, non-exclusive license to process your photo using our AI service solely for the purpose of generating your edited image. This license terminates when your photo is deleted from our servers.

Edited Images: The edited images generated by Peekaboop are provided to you for your personal use. You may use, share, and distribute edited images as you see fit.

Your Responsibility: You are solely responsible for ensuring you have the necessary rights and permissions to upload and edit photos, particularly photos containing other people (including children). Peekaboop is not responsible for your use of the service or edited images.

7. Credits and Payment

Credits System: Generating an edited image consumes credits as described in the app. Credits are purchased through in-app purchases or credit packs.

Non-Refundable: Credits are non-refundable once purchased, except as required by law or in cases of technical failure on our part.

Failed Edits: If an edit fails due to a technical error on our part, the credits will be refunded to your account.

Pricing Changes: We may change credit pricing or credit pack offerings at any time. We will provide reasonable notice where possible. Changes do not affect credits already purchased.

Free Beta: During the beta period, Peekaboop may be offered for free or with free credits. We reserve the right to change this at any time.

8. Service Availability

"As Is" Service: Peekaboop is provided "as is" and "as available" without warranties of any kind, either express or implied.

No Guarantees: We do not guarantee that:

• The service will be uninterrupted, timely, secure, or error-free

• The results from using the service will be accurate or reliable

• Any errors in the service will be corrected

• The service will meet your specific requirements

AI Limitations: AI-generated results may vary in quality. We do not guarantee perfect results for every photo. Factors such as image quality, lighting, angles, and facial positioning may affect results.

9. Third-Party Services

Peekaboop uses third-party services (including Google Vertex AI) to provide the service. These third-party services have their own terms and privacy policies. We are not responsible for the practices or content of third-party services.

10. Limitation of Liability

To the maximum extent permitted by law:

No Liability for Damages: Peekaboop Limited, its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, or other intangible losses, resulting from:

• Your use or inability to use the service

• Unauthorized access to or alteration of your content

• Any conduct or content of any third party on the service

• Any content obtained from the service

Maximum Liability: Our total liability to you for all claims arising from your use of Peekaboop shall not exceed the amount you paid to Peekaboop in the 12 months prior to the claim, or £100, whichever is greater.

Exceptions: Nothing in these terms excludes or limits our liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under UK law.

11. Indemnification

You agree to indemnify, defend, and hold harmless Peekaboop Limited, its directors, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with:

• Your use of the service

• Your uploaded content

• Your violation of these terms

• Your violation of any rights of another person or entity

• Your violation of any applicable laws or regulations

12. Data Protection and Privacy

Your use of Peekaboop is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using Peekaboop, you consent to our data practices as described in the Privacy Policy.

13. Intellectual Property

Peekaboop's IP: The Peekaboop service, including its software, design, text, graphics, logos, and other content (excluding user-uploaded content) is owned by Peekaboop Limited and is protected by copyright, trademark, and other intellectual property laws.

License to Use: We grant you a limited, non-exclusive, non-transferable license to access and use Peekaboop for your personal, non-commercial use, subject to these terms.

Restrictions: You may not:

• Copy, modify, distribute, sell, or lease any part of our service

• Reverse engineer or attempt to extract the source code of our software

• Use our trademarks or branding without written permission

14. Termination

Your Right to Terminate: You may stop using Peekaboop and delete your account at any time.

Our Right to Terminate: We may suspend or terminate your access to Peekaboop at any time, with or without notice, if:

• You violate these terms

• Your use of the service poses a risk to us, other users, or third parties

• We are required to do so by law

• We decide to discontinue the service

Effect of Termination: Upon termination:

• Your right to use Peekaboop immediately ceases

• Your account data will be deleted in accordance with our Privacy Policy

• Unused credits are forfeited (non-refundable)

• Sections of these terms that by their nature should survive termination will remain in effect

15. Dispute Resolution

Governing Law: These terms are governed by the laws of England and Wales, without regard to conflict of law provisions.

Jurisdiction: Any disputes arising from these terms or your use of Peekaboop shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Informal Resolution: Before filing a claim, you agree to try to resolve the dispute informally by contacting us at alex@peekaboop.co.uk. We will attempt to resolve the dispute informally within 60 days.

16. Changes to Terms

We may update these Terms of Service from time to time. When we make changes:

• We will update the "Last updated" date at the top of this page

• We will post the updated terms on our website and in the app

• For material changes, we will notify you by email or in-app notification at least 30 days before the changes take effect

Your continued use of Peekaboop after changes take effect constitutes your acceptance of the updated terms. If you do not agree to the updated terms, you must stop using the service.

17. General Provisions

Entire Agreement: These terms, together with our Privacy Policy, constitute the entire agreement between you and Peekaboop Limited regarding your use of the service.

Severability: If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

No Waiver: Our failure to enforce any right or provision of these terms will not be considered a waiver of those rights.

Assignment: You may not assign or transfer these terms or your account to anyone else. We may assign these terms to any affiliate or successor without restriction.

Force Majeure: We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control.
